Release 4 – February 2000

PRESS RELEASE

February 27, 2000

On Monday, February 28 at 9:00 a.m. in Martinez Superior Court, Department 28, 1020 Ward Street, 2nd Floor, a trial will be held for Timothy Mulgrew, who is charged with Felony Cruelty to an Animal for shooting Cole, his neighbor's one-year-old black Labrador.

A jury trial had been scheduled, but in an unusual move, the defense requested that the judge take the case "on the record." This means that no jury trial will be held. On Monday morning, only one witness--Timothy Mulgrew--will be questioned by his attorney, then cross-examined by the district attorney. The judge will examine the transcript of testimony from an earlier preliminary hearing, police report, etc. The judge will then decide the case based on the above.

Deputy D.A. Stacey Grassini said he expects the trial to be over by early afternoon.
